Welcome to Ormelya. These Terms of Service govern your access to and use of ormelyaparis.com (the "Site") and the purchase of products from our online store. By using the Site or placing an order, you confirm that you have read, understood, and accept these Terms in their entirety.

These Terms are concluded between, on the one hand, Nassim Habbout operating as Ormelya, hereinafter "Ormelya", "we", or "us", and, on the other hand, any individual visiting or purchasing from the Site, hereinafter "you", "the Customer", or "the User". They are written in English and govern any contract entered into through the Site.

1. Identification

Ormelya is the trade name of Nassim Habbout, entrepreneur individuel registered in France under SIRET 98940589900018. Postal address: 24 Rue Isabelle de Portugal, 21000 Dijon, France. 2. Definitions
Site: the website accessible at ormelyaparis.com.
Products: all jewellery boxes and related items offered for sale on the Site.
Customer: any natural person of legal age placing an order on the Site for purposes outside their commercial activity.
Order: any request for the purchase of one or more Products made by the Customer through the Site.
Parties: Ormelya and the Customer collectively.
3. Scope and Acceptance

These Terms apply to every Order placed through the Site. They are made available on every page and must be accepted before an Order can be confirmed. Acceptance is final and constitutes a binding contract between the Parties.

Ormelya reserves the right to amend these Terms at any time. The version applicable to your Order is the one displayed on the Site at the moment of validation.

4. Products

Each Product is presented with photographs, a description, its essential features, and its price. We strive for accuracy in colours and dimensions; however, slight variations may occur due to your screen settings or the artisanal nature of our pieces.

Our Products are crafted in limited series; offers are valid while stocks last. Should an item become unavailable after your Order, we will inform you within five (5) business days and propose either a partial refund, an exchange, or full cancellation with full reimbursement.

5. Prices

Prices are displayed in US dollars (or the currency you have selected). They include all taxes applicable in the destination country where Ormelya is required to collect them. Shipping costs are calculated at checkout and shown before validation.

For shipments outside the United States, customs duties and import taxes may apply. They are the responsibility of the Customer (see our Shipping Policy). Ormelya reserves the right to modify its prices at any time; the price applicable to an Order is the one in force at the time of validation.

6. Order Process

Placing an Order involves four steps:

Selection of Products and addition to the cart.
Verification of the cart, entry of delivery and billing addresses.
Choice of payment method and acceptance of these Terms.
Final validation of the Order ("place order" button), which forms a binding contract.

A confirmation email summarising the Order is sent within minutes. Should you not receive it, please check your spam folder, then contact hello@ormelyaparis.com.

7. Payment

We accept payment by major credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, PayPal, and Shop Pay. All transactions are encrypted and processed by PCI-DSS-certified providers. Ormelya never has access to your full card details.

In the event of suspected fraud, we reserve the right to request additional verification or to cancel the Order, with full refund of any amount already paid.

8. Delivery

Delivery times and costs are detailed in our Shipping Policy. Delivery is performed at the address provided by the Customer; Ormelya cannot be held liable for delays caused by inaccurate or incomplete addresses.

Pursuant to article L216-1 of the French Consumer Code, if delivery has not occurred within thirty (30) days of the Order, you may, after sending us a written request to deliver within a reasonable additional period, cancel the Order and obtain a full refund within fourteen (14) days.

9. Right of Withdrawal

Pursuant to articles L221-18 and following of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal, without having to justify their decision or to pay any penalty.

As a courtesy, Ormelya extends this period to thirty (30) days from delivery for most Products. Detailed return instructions are set out in our Refund Policy.

In accordance with article L221-28 of the Consumer Code, the right of withdrawal does not apply to Products that have been personalised, engraved, or made to the Customer's specifications.

10. Legal Warranties

Independently of any commercial guarantee, all our Products benefit from:

The legal warranty of conformity (articles L217-3 to L217-17 of the French Consumer Code), which gives the Customer two (2) years from delivery to obtain repair, replacement, or refund of a non-conforming Product.
The warranty against hidden defects (articles 1641 to 1648 of the French Civil Code), which allows the Customer to obtain reimbursement or a price reduction within two years of discovery of the defect.

To exercise these warranties, please contact hello@ormelyaparis.com with a description of the issue and photographs. We respond within five (5) business days and bear the return shipping costs.

11. Liability

Ormelya undertakes a best-efforts obligation in the performance of its services. Our liability is limited to direct damage caused by a proven failure on our part and shall not exceed the amount of the Order in question. We cannot be held liable for indirect damages, loss of opportunity, or consequential damages, nor for events of force majeure.

12. Force Majeure

Neither Party shall be held liable for any failure or delay caused by an event of force majeure as defined in article 1218 of the French Civil Code (natural disasters, war, strikes, pandemics, network failures, governmental restrictions, etc.).

13. Intellectual Property

All elements of the Site (texts, photographs, graphics, logos, videos, code) and the Products themselves are the exclusive property of Ormelya or its partners and are protected by French and international intellectual property law. Any reproduction, representation, or use, in whole or in part, without the prior written authorisation of Ormelya, is strictly prohibited.

14. Personal Data

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.

15. Customer Care

For any question, claim, or after-sales request, our team is at your disposal at hello@ormelyaparis.com. We acknowledge written claims within 48 hours and respond within five (5) business days.

16. Mediation and Online Dispute Resolution

In case of dispute, we invite you to first contact our customer care team. Should no amicable solution be found within sixty (60) days, the Customer may refer the dispute, free of charge, to a consumer mediator listed on the website of the French Mediation Commission (mediation-conso.fr).

Pursuant to Regulation (EU) No 524/2013, the European Commission also provides an online dispute resolution platform accessible at ec.europa.eu/consumers/odr.

17. Governing Law and Jurisdiction

These Terms are governed by French law. In the absence of an amicable solution, any dispute shall be submitted to the competent courts of the place of residence of the consumer Customer or of the registered place of business of Nassim Habbout (operating as Ormelya), at the Customer's choice.

18. Severability and Entire Agreement

Should any provision of these Terms be declared invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, the Refund Policy, and the Shipping Policy, constitute the entire agreement between the Parties regarding the subject matter hereof.
